The dispute over whether the US military can bar its contractors from using Anthropic's models over the company's limits on their use goes back to the same court.
Anthropic's lawyers filed a petition on Tuesday for the appeal to be reheard. In March the US Department of Defense, led by Pete Hegseth, labeled the company a "national security supply chain risk," which bars the department's contractors from using its technology, after talks collapsed over the terms on which the military could use Claude models. Anthropic challenged the decision in court; in September the US Court of Appeals for the D.C. Circuit, ruling 2–1, left the ban in place, rejecting the company's argument that it was arbitrary, unauthorized and unconstitutional. According to the petition (as quoted by CNBC), the label was applied because the company refused to allow its models to be used for mass surveillance of Americans and lethal autonomous weapons; the Defense Department's position on the new petition is not given in the text that was read.
