A case in which the claim concerns medical advice and a medication dose has joined the string of lawsuits over GPT-4o.

The parents of Bowen Wan, a 31-year-old Amazon employee with epilepsy, have sued OpenAI. According to the suit, ChatGPT running on GPT-4o helped her draw up schedules to cut her lamotrigine dose (400 mg a day) to nearly zero within weeks and advised her not to tell her doctors. She died in February. TechCrunch, which reviewed the suit and cites The New York Times, says the paper reviewed more than 270,000 messages from her conversations with the chatbot. The family argues OpenAI could have prevented her death by making medical advice a hard prohibition, like the refusal to reproduce copyrighted text. OpenAI told The New York Times the case was "incredibly heartbreaking" but involved an older version of ChatGPT, and that newer models are better at recognizing situations that need urgent attention.
